Terms of use and server rules

This is a translation for your convenience. Legally binding is the German version of this page at livingen.de/regeln/ — only that wording counts in case of doubt.

1. What LIVINGEN is

LIVINGEN is a free notification service. We read publicly accessible rental listings from housing portals and housing companies, sort them by German state and post them into Discord channels. LIVINGEN is not an estate agent, not a housing agency and not a contracting party in a tenancy. We charge no commission and conclude no contracts about flats.

2. What the service costs

For you, nothing. Access runs through an advertising link; the advertising revenue covers the server and operations. There is no billing, no subscription and no payment details — not later either. Anyone demanding payment in the name of LIVINGEN is not acting on our behalf.

3. No warranty for the listings

The details in a listing come from the respective provider, not from us. We check neither price, size, availability nor the trustworthiness of the provider, and we cannot. Listings may already be taken by the time you write. They may be inaccurate. And there are scam attempts — what to watch out for is on the page “How you get the flat”. Never pay a deposit before a viewing.

4. No guaranteed availability

LIVINGEN runs as well as it can, but without any guarantee. Portals change their pages, block access or go down; listings from that source are then missing until the reader has been repaired. We do not announce maintenance windows. There is no entitlement to access, to a certain number of listings or to a certain speed.

5. Rules on the server

Welcome: questions, experiences, reports of broken channels, helping each other with applications. Not welcome and grounds for exclusion: advertising and self-promotion without prior agreement, reselling listings or access, automated reading of the channels, insults, discrimination, harassment of other members, publishing other people's personal data, and scam attempts against other members. The Discord Terms of Service and Community Guidelines apply in addition.

6. Reusing content

The listings belong to their providers; photos and texts are subject to their rights. You may use the channel content for your own flat search — not to mirror it, resell it or feed it into a service of your own. Automated reading of the channels is prohibited.

7. Exclusion and termination

You can leave the server at any time; that ends your use. We may withdraw access without prior notice in the event of breaches of these rules and may discontinue the service at any time. No claims arise from this — the service is free of charge.

8. Liability

We are liable for intent and gross negligence, and for injury to life, body and health, in accordance with statutory provisions. Otherwise liability for ordinary negligence is excluded unless a material contractual obligation is affected. In particular we accept no liability for damage arising from reliance on a listing, from a tenancy agreement not obtained, or from the conduct of third parties — including providers and other members.

Application generator and email offers

The application generator produces a suggested text from the details you enter yourself. It is a drafting aid, not legal advice; check the text before sending it and add the property and address. Whether an application succeeds is decided by the landlord alone. You provide the email address voluntarily. By ticking the box you consent to us occasionally sending you offers and news from LIVINGEN. You can withdraw at any time without any disadvantage; the generator stays usable afterwards. 9. Changes

These rules may change, for example when new sources or channels are added. The version in force is always the one on this page; we announce significant changes on the server.
